General Terms and Conditions

General Terms and Conditions

1. Scope and seller

These General Terms and Conditions apply to purchases made through the SPARELIA online shop by consumers and, where relevant, business customers.

The seller is:

Kamenikova Masiarova Monika

Magurska 8, 34-480 Jablonka, Poland

Business ID: 520102815

Tax ID: 6751669480

EU VAT ID: PL6751669480

Email: [email protected]

Telephone: +36 30 42208002

A consumer is a natural person acting mainly outside their trade, business, craft or profession. Mandatory consumer rights always prevail over any conflicting provision of these Terms.

2. Product information and compatibility

Product descriptions, photographs, manufacturer references, original part numbers, compatibility data and technical parameters are provided to identify the spare part. Minor colour or packaging differences that do not affect function may occur.

Before ordering, compare the appliance model, service or type number, dimensions, connectors and the original part number. If compatibility is uncertain, contact us before ordering. This recommendation does not limit statutory rights where the delivered product is not in conformity with the contract.

3. Prices, taxes and currencies

The price shown in the selected shop language and currency at checkout is the price applicable to the order. Consumer prices include the applicable VAT unless the checkout clearly states otherwise. Delivery and any other permitted charges are shown before the order is submitted.

For cross-border EU sales, VAT may be calculated according to the destination country. Currency conversions, where offered, are displayed before the order is submitted.

4. Ordering and conclusion of the contract

Product presentation in the shop is an invitation to place an order. By pressing the order button, the customer submits a binding offer for the products in the cart after having had the opportunity to review and correct the order data.

The automatic order-receipt email confirms that the order reached our system. This automatic receipt does not mean that we accepted the order. The contract is concluded when we expressly accept the order, confirm that it is being fulfilled, or dispatch the goods.

The order confirmation and these Terms are provided on a durable medium, normally by email. Keep the order number for communication, bank transfers, withdrawal and complaints.

5. Payment

The payment methods currently available are displayed at checkout. They may include bank transfer and electronic card or wallet payments handled by the payment provider shown at checkout.

For a bank transfer, use the order number as the payment reference.

Account holder: Kamenikova Masiarova Monika

IBAN: SK38 8330 0000 0028 0322 9860

BIC/SWIFT: FIOZSKBAXXX

Payment is due under the conditions displayed for the selected payment method. We do not receive full card details from the payment provider. Title to the goods remains with the seller until the price has been paid in full, without affecting the consumer-risk rules for delivery.

6. Availability and delivery

The standard availability stated for products is 3–7 business days. This is an expected procurement or dispatch period, not a guaranteed delivery date. The actual method, destination availability, price and estimated delivery time are displayed at checkout.

If fulfilment is delayed or impossible, we will inform the customer without undue delay and offer an appropriate solution, including a new delivery date or refund where required. The seller bears the risk of loss or damage until the consumer or a person designated by the consumer receives the goods, except where the consumer independently appoints a carrier not offered by the seller.

7. Right of withdrawal

A consumer may withdraw from a distance contract without giving a reason. The withdrawal period is 14 days. It begins on the day when the consumer, or a person designated by the consumer other than the carrier, receives the goods. Special rules apply where several goods are delivered separately.

The consumer may use the clearly marked online withdrawal function, the model withdrawal form, email or an unambiguous written statement. Detailed instructions, deadlines, return costs, refund rules and statutory exceptions are set out on the Returns, Withdrawal and Complaints page.

The online withdrawal function remains available during the withdrawal period and sends an acknowledgement of receipt on a durable medium.

8. Complaints and legal conformity guarantee

The seller is liable for a lack of conformity that becomes apparent within two years from delivery, without prejudice to any longer mandatory protection applicable in the consumer's country of residence.

A consumer may request repair or replacement free of charge. A price reduction or termination may be available where the statutory conditions are met, including where repair or replacement is impossible, refused, not completed within a reasonable time, or would cause significant inconvenience.

A complaint may be submitted in any form. Proof of purchase helps identify the order, but a receipt is not the only acceptable proof. The seller responds to a consumer complaint within 14 days of receipt where Polish law requires this. Costs of a justified conformity complaint, including necessary transport, are borne by the seller.

9. Installation and safe use

Disconnect the appliance from power and follow the appliance manufacturer's instructions before fitting a spare part. Work involving mains voltage, gas, refrigerants or safety-critical components must be performed by a qualified person where required.

Nothing in this section excludes liability that cannot lawfully be excluded or limits rights relating to a defective or incorrectly described product.

10. Personal data and cookies

Personal data are processed to operate the shop, conclude and fulfil contracts, handle payments, delivery, customer accounts, returns, complaints and legal duties. Details are provided in the Privacy and Cookie Policy. Non-essential analytics and marketing cookies are used only under the choices recorded in the cookie settings.

11. Customer service and dispute resolution

Please first contact us at [email protected] so that we can resolve the matter directly. Consumers may also use the competent consumer ombudsman, Trade Inspection authority or another authorised alternative dispute resolution body. Cross-border consumers may seek help from the European Consumer Centres Network.

The former EU Online Dispute Resolution platform has been discontinued and is therefore not linked from this shop.

12. Applicable law and mandatory consumer protection

Polish law applies to the contract to the extent permitted. This choice cannot remove mandatory consumer protection. Where EU conflict-of-law rules apply, the consumer also keeps the mandatory protection of the country where the consumer normally lives.

The contract language is the language selected by the customer in the shop. Each language version is intended to have the same meaning. Any ambiguity must be interpreted consistently with mandatory consumer law and, where required, in the consumer's favour.

13. Final provisions

If any provision is invalid, the remaining provisions continue to apply. We may update these Terms for future orders; the version supplied with an order governs that order. Effective date: 20 August 2026.

2. Data, purposes and legal bases

We process identification and contact data, billing and delivery data, order and product data, account data, payment status, communications, returns and complaint data, consent choices and necessary technical logs.

Data are processed to take steps requested before a contract and to perform the contract; comply with accounting, tax, consumer-protection, product-safety and other legal duties; pursue legitimate interests such as service security, fraud prevention, claim handling and improvement; and, where required, on the basis of consent for newsletters, analytics or marketing.

3. Recipients and processors

Inquiry and complaint data are retained until the case is resolved and for any necessary limitation period. Newsletter data are retained until consent is withdrawn or an objection is made. Technical logs are retained only for a proportionate security and diagnostic period.

5. Your rights

Subject to the conditions in the GDPR, you may request access, rectification, erasure, restriction, data portability, or object to processing based on legitimate interests or direct marketing. Consent may be withdrawn at any time without affecting earlier lawful processing. You also have the right to lodge a complaint with the President of the Polish Personal Data Protection Office or, where applicable, another competent supervisory authority.

To exercise a right, email [email protected]. We may need to verify identity before disclosing or changing personal data.

6. Cookies and similar technologies

Strictly necessary cookies support the cart, login, language, currency, security and consent preferences and are used where necessary to provide the requested service. Analytics, personalisation and advertising technologies are used only in accordance with the choices recorded in the cookie banner where consent is required.

You can change non-essential cookie choices using the cookie settings on the shop. Browser settings can also delete or block cookies, but blocking necessary cookies may prevent parts of the shop from working.

7. Automated decisions and updates

We do not make decisions producing legal or similarly significant effects based solely on automated processing unless this is necessary for a contract, authorised by law, or based on explicit consent with the safeguards required by law. Fraud and payment services may perform automated risk checks under their own notices.

We may update this notice when processing or legal requirements change. The current version and effective date are published here. Effective date: 20 August 2026.
